The ABCs of Avoiding a Custody Battle

Situations When Beneficiaries Would Hire A Probate Attorney

by Barry Webb

If assets aren't in a trust, then probate will happen after a loved one passes away. Beneficiaries will be involved and sometimes, they need help from a probate attorney. These situations would make sense for beneficiaries to utilize a probate attorney's legal services.

Many Different Assets Involved

There are some people that have all kinds of assets when they pass away. They may not have had time to think about where each of these assets should go when they pass on, which creates problems for beneficiaries. If you and your family are in this spot, hire a probate attorney.

They can manage all of these assets properly by seeing what plans there are and what each beneficiary wants to do. The probate attorney will have an easier time keeping track of all of these personal requests and ensuring each beneficiary ends up with what they're supposed to. That can reduce the occurrence of conflict.

Life Insurance Policies Need to be Paid

If the loved one that passes had life insurance policies, then they'll need to be distributed as well to the proper beneficiaries. They're just as important as the other assets and to ensure these life insurance policies are managed properly, a probate attorney can step in.

They'll make sure the life insurance policies are paid fairly by the providers and see to it that this money ends up with the right beneficiaries. They can also help put the money from life insurance policies in a trust if that's what the loved one wanted to happen before they passed on.

No Will Was Created

Not everyone has the chance to create a will before they pass on. If this were to happen to your family, then figuring things out as beneficiaries can be very difficult and cause your family to waste a lot of time.

You need to hire a probate attorney to figure out what needs to be done in the absence of a will. That's going to help probate go by a lot faster and keep everyone on the same page about what's going to happen.

Probate will end up happening after a loved one with assets passes away, and some situations make it a requirement to work with a probate attorney. If you are in this position, make sure you hire a probate attorney quickly so that they can advise you on important matters that will affect how things play out.
